Burglary is a crime where a person enters a building with the intention of committing a crime. Burglary is also known as breaking and entering or housebreaking.
Aggravated burglary is defined as a burglary where the burglar enters a building with the intention of committing a crime but he has with him a firearm, imitation firearm, weapon of offence or an explosive. Usually the burglar uses the weapon to intimidate the residents of the house or building so that he or she can commit the crime.
A person is guilty of aggravated burglary if he or she commits a burglary and has in his or her possession the following:
- Firearm -- a firearm includes an air gun, air pistol or even an imitation firearm. Anything that has an appearance of a firearm is considered one whether it has the ability to discharge or not.
- Weapon of offence -- a weapon of offence is any item or article that is made or especially adapted so that it can cause injury to a person or incapacitate a person.
- Explosive -- explosive refers to any article that is manufactured for the purpose of causing an explosion.
If a person is convicted of aggravated burglary, depending on the laws of the state, he or she can be liable to imprisonment for life. A burglary is usually considered to be a felony and besides imprisonment, the convicted person can also be fined.
A person who is convicted of this type of burglary has to enter a building for the purpose of committing a crime. The entry into the building has to be unauthorized and it is not necessary that the building is occupied by a person when the burglar enters it. There is sufficient cause to convict a person for aggravated burglary if the building gets occupied at any time during the burglary.
