Can an expunged record be accessed by law enforcement ?

     Before the invention of internet, it was not very easy to access personal record of anyone, except you are working for law enforcements.  

            Nowadays it is pretty easy. Almost anyone with a visa card can easily view your personal criminal background profile. In fact, criminal background check is almost expected, when you are applying for a job or dealing with important financial situations. Your privacy rights do not apply criminal records. Your privacy rights are only protected for successful expungement.

            Can an expunged record be accessed by law enforcement ? Unfortunately, Yes. Even if the record are expunged, it does not mean that the records are destroyed. It can still be accessed by a certain number of people for limited reasons. Here is a good example. Let say that you are applying for a real estate manager position. Your potential employer may ask you about your criminal background. You have to let them know about expunged conviction. Law enforcement officials also have the rights to look at your expunged records for criminal investigations.

Why should you expunge your criminal records?

    • Employers have rights to terminate employees with prior conviction in many states.
    • If you are arrested but never convicted, your potential employers have the right to deny jobs in many states.
