Accidental Manslaughter And Juvenile
In layman’s terms, the unlawful killing of another person without premeditation or an evil intent to kill is known as manslaughter.

There are two levels of manslaughter: voluntary and involuntary.

Voluntary manslaughter is killing someone in the heat of passion or while committing a felony. Involuntary manslaughter, also known as accidental manslaughter, is when you kill someone during a non-felony.

If a juvenile commits an accidental manslaughter, he will be judged as per the juvenile law of the state where the incident happened. In the US, most states have juvenile law and the main purpose of the law is not to punish and incarcerate the juvenile. Instead it focuses on rehabilitation. However, a juvenile can be tried in an adult court if the juvenile court gives up its jurisdiction.

Usually, in the United States, a juvenile is a child under the age of eighteen. Cases involving juveniles are heard by the family division of the circuit court. If a child under the age of eighteen commits accidental manslaughter, he will be tried according to the Federal Juvenile Delinquency Act. Even state laws must comply by the juvenile court procedures and punishments. The courts that try juveniles have their own special rules and procedures.

If a juvenile is found guilty of accidental manslaughter, he will be sent either to a reform school or a public institution. Many times, the teenager or the child is placed under probation and he is required to do community service. The court will always take into consideration that the killing was not planned and it happened in the heat of the moment. Many accidental manslaughter cases involving juveniles happen because of reckless driving and under these circumstances, the license, if any, is taken away or the child will not be allowed to get a driving license until he reaches the age of 21. Once the child reaches adulthood, his files are sealed and cannot be opened.
