However, if there is no prenuptial agreement, couples usually divide the property and the assets equally. The property is put on sale and the proceeds from the sale are divided between the couple.
However, in some states in the U.S., it is the court that decides the share, and this decision means that the share can be equal or not. However, before the court decides the share, number of factors are taken into consideration. These include the length of the marriage, contribution of each spouse towards acquisition of assets, education of children, health, age, income and conduct of marriage amongst others.

In a divorce the most important asset is usually the home. The first priority in any divorce is to provide a home and sense of security for the children. So, whether the home is owned jointly or by one spouse, there could be a necessity to sell the home and divide the proceeds of the home among the couple in order to meet the requirements of the children. The ideal situation would be to provide the children with a new home. However, the money after the division invariably is may not be enough to purchase a new home for the children.
The court takes all these criteria into consideration and only then does it decide whether the home should be sold.
