Marriage Law

          Marriage law is usually regulated by nations or states, and requires certification by the state. Before getting married, there are certain requirements that you must fulfill:

  • Age requirements: In most cases, marriage of minors is prohibited by law. In some jurisdictions, it may be permissible after obtaining parental permission.
  • Multiple spouses: Marriage laws in Western countries prohibit a person from having more than one spouse at a time. A marriage will be declared invalid if one spouse was unaware about a previous marriage still in existence.
  • Marriage certification: The person who performs the marriage will complete a marriage certificate, which is also signed by witnesses to the marriage.

          In most cases, the wife’s name does not automatically change after marriage. If she desires to do it, she will have to request it to the appropriate government agencies.

          Sometimes, when people get married, they create prenuptial agreements to help determine the division of property and spousal support in the event of divorce. Prenuptial agreements are common where one spouse has considerable assets, while the other has fewer assets.

                    If you have sufficient assets to consider a prenuptial agreement, it is a good idea to go for it. While it cannot assure that a divorce will not be contentious, it does help.  It will provide you with some financial protection in the event of divorce. Be aware that you will have to declare all your assets in case you want a “prenup” enforced. If you have any hidden assets, you may not be able to enforce the agreement.
